1. General provisions
By establishing an effective reception scheme for operating waste the Port of Esbjerg intends to contribute positively to obtain a positive environmental effect through responsible handling of the waste from the ships. In order to make it easy for ships calling at the port to deliver their waste, which positively contributes to reduce the environmental pollution of the seas, the goal of the scheme is flexibility.
    
    
2. Responsibilities
The board of the Port of Esbjerg is responsible for working out the reception scheme.

The port director is responsible for the implementation and updating of the scheme.

3. General terms for the reception scheme
The Port of Esbjerg has established a waste reception scheme for operating waste from ships in accordance with the Executive Order from the Ministry of Energy and Environment No. 1003 dated December 10, 2002.
For administrative purposes the port has been divided in three separate sections: The Commercial, the Fishery and the Leisure port section.
Ships calling at the Port shall register the quantity and type of waste that is expected to be on board during call. At the same time the ship shall indicate the quantity intended to be delivered. Exempt are the ships that have obtained a dispensation according to the Executive Order's § 18.

The following rules should be followed:

Business hours.
Delivery of waste shall take place during the normal working hours of the Port, Monday through Friday 0700 hours till 1400 hours.

Ships that - due to their regular schedule - call at the Port outside normal working hours can deliver their waste if it is documented that delivery cannot take place within normal hours. In such a case certain conditions shall apply to the specific type of waste the ship want to deliver.

Notification
The Port shall be notified about the ship’s arrival and the delivery preferably 24 hours prior to arrival.

The notification form can be obtained by contacting the Port Control, Auktionsgade 30 or by filling in the attached electronic form.

The notification form shall be returned to the Port Control either by fax No. +45 7513 3167 or by E-mail  using the attached electronic form.

Quantities
It is free of charge only to deliver quantities that relates to the ship’s type, its size and the duration of its latest voyage.

Charges
A special fee will be charged in the following cases:
- If the quantity of operating waste exceeds the quantity a ship normally would have produced
  since last port of call.
- If the operating waste is delivered outside normal working hours
- If the ship does not pay ships and cargo dues
- If a notification of delivery of operating waste has not been received 24 hours prior to the call
- If operating waste is not placed in the designated containers
- If the sludge (slopoil) is containing less than 65 % oil or contains other substances than oil and water.
- Delays, irrespective of the cause, for example attendance to the ship in vain or lower pump capacity
  than expected, will be duly charged.

Categories of waste
Port of Esbjerg can receive:
- Oil and chemical waste
- Residues and mixtures of liquid bulk
- Hazardous material when properly packaged for further handling
- Oleaginous waste, containing emulsifying substances
- Sewage water
- Operating waste (slop oil etc.)

Ownership
The ownership to the operating waste is transferred to the Port of Esbjerg when the waste is ashore.

Liability
The ship’s owner is liable for the accuracy of all information given by the ship’s master concerning the waste, including its type, composition, quantity, the time for collection as well as for any damages resulting from errors or deficiencies. The ship’s owner is thus regardless of fault liable for any damage whatsoever resulting from the master’s incorrect, misleading or deficient information. This also applies to damages incurred to any third party due to the master’s incorrect, misleading or deficient information.

According to the Executive Order No. 1003 a ship that for example refrains from delivering waste in compliance with the rules laid down in the Executive Order or does not follow the rules for pre-advisement, can be sentenced to a fine or if it is considered an act of gross negligence to ordinary imprisonment or up to 2 years jail.

4. Means of collection and disposal
Depending on the quantity/volume of the operating waste containers and/or a tank truck can be prearranged.

The Port receives oil waste (sludge, slop oil) in drums and cans as well. The ship is still responsible for the proper filling of these containers and it is also the ship’s responsibility to give proper information about the location of the above-mentioned containers.

6. Consultation with the clients
The Port of Esbjerg invites yearly a range of the regular users of the scheme to a discussion of the scheme’s functionality.
    
    
7. Date of enforcement
This scheme comes into force on December 27, 2002 and earlier Executive Orders on this matter are revoked
